NIGEL NEWTON PHOTOGRAPHY
Terms of Business
It is mutually agreed that the following terms form an integral part of this contract and that no variation or modification shall be effective unless accepted by Nigel Newton Photography in writing.
Booking Fee
A booking fee of 50% of the agreed final price is required when the Client signs the contract. Dates are reserved only when the booking fee is paid. This sum will apply towards the contract fee.
Payments
The balance of the payment for the services contracted for must be paid NOT LATER THAN 30 DAYS prior to the wedding. Payment for additional photographs and albums is made when these are ordered.
Cancellation
In the event of the Client cancelling a booking for wedding photography, Nigel Newton Photography reserves the right to retain the booking fee at their own discretion.
We strongly advise the Client to take out their own Wedding Insurance policy to cover for the eventuality of Nigel Newton Photography being unable to provide the agreed photography services.
Weather and/or Delays
The photographs will be taken as agreed weather permitting. In the event of inclement weather,
Nigel Newton Photography, in cooperation with the Client, will make any necessary changes to the schedule and will do his best to provide coverage of the event within the time allocated.
Requested Photographs
Nigel Newton Photography will honour requests for specific photographs subject to: weather, time, availability and cooperation of the person(s) concerned. Such requests should be expressed at the booking stage.
Coverage
Nigel Newton Photography cannot be held responsible for the lack of coverage caused by the bride, bridegroom or other members of the wedding party not being ready on time, nor by restrictions placed on the photographer by officials of the church, registry office or other venues. The photographer is limited by the guidelines of the ceremony official or reception site manager. Negotiation with the officials for adjustments to any guidelines is the responsibility of the Client. Nigel Newton Photography will only make technical recommendations.
Colour Matching
It is not always possible to record on camera the exact colour of materials as perceived by the human eye. Nigel Newton Photography will endeavour to achieve a pleasing overall colour balance when processing images. It is understood that some tones and colours may not appear consistent throughout a set of images due to a variety of lighting conditions. The Client should also be aware that the colour balance of prints made at different times and varying sizes may also be variable.
Copyright
The copyright in all photographs created by Nigel Newton Photography shall remain the property of
Nigel Newton Photography. Licensed Images supplied by us on a USB Memory Stick as high resolution jpeg format digital files will be suitable for printing up to size 60x40cm. They are licensed to the Client for sharing or displaying electronically with family and friends, and for printing by the Bride and Groom only. Other family and friends of the Client can order prints from Nigel Newton Photography. Image files must not be copied, altered or sold in any way whatsoever.
Nigel Newton Photography accepts no responsibility for the quality and colour reproduced from third party printers of images taken from copyright free images supplied, due to variations in paper and third party printing processes and profiles.
Negatives and Electronic Images
All negatives (RAW files) and electronic images created by Nigel Newton Photography shall remain the property of Nigel Newton Photography who undertakes to store all such files and images safely and make them available for future reproduction. Photographic prints will become and remain the property of the Client, who in turn acknowledges that ownership of prints does not imply ownership of the copyright of the original digital files.
Model Release
The Client grants Nigel Newton Photography the right to use and publish photographs of the Client for editorial, trade, advertising and any other purpose and in any manner and medium. Restrictions on photographing any particular guest(s) present at the wedding should be discussed at the booking stage.
The client hereby releases Nigel Newton Photography from all claims and liability relating to said photographs.
